RiseSwap Terms of Service
Effective date: 2 November 2026
1. Agreement
These Terms are an agreement between you and RISE EQUIPMENT, LLC ("we", "us"), the operator of the RiseSwap app. You must read and agree to these Terms and the Privacy Policy before you sign in. If you do not agree, do not use RiseSwap.
2. What RiseSwap does
- RiseSwap buys unused gift cards from you. We are the buyer and you are the seller.
- We pay you in Nigerian Naira (NGN) to a bank account in your own name.
- We do not issue, sell or resell gift cards, redemption codes or digital content to you, and we do not sell any digital goods through Apple In-App Purchase.
- RiseSwap is not a bank, a currency exchange or a crypto-asset service, and it is not a peer-to-peer marketplace.
3. Eligibility and your account
- You must be at least 18 years old.
- You sign in with a one-time code sent to your email address or Nigerian mobile number. Keep access to that email or phone secure.
- Actions taken through your account are treated as yours.
- Do not open an account for someone else or open more than one account. We may restrict or close duplicate or linked accounts that are used for abuse.
- Before you sell or withdraw, we may ask you to complete identity verification (KYC).
4. Selling gift cards
- You confirm that you lawfully own each card you submit, that it was obtained legally, and that the information you give is accurate.
- When you submit a card, you authorise us to verify it.
- Rates shown in the app are for reference. The final amount is based on the verification result and is shown in your order before it is settled.
- We may reject cards that are invalid, already used, reported or restricted by the issuer, or flagged by our risk checks. We do not guarantee that we will buy every card.
- Do not submit payment cards (credit or debit cards) or cards from unknown or unlawful sources.
5. Scam warning
No legitimate business or government agency asks to be paid in gift cards. If someone asked you to buy gift cards to pay a bill, fee, fine or prize charge, you may be the victim of a scam. Do not sell those cards. Contact our support team and your local authorities.
6. Wallet and withdrawals
- Settled amounts are credited to your RiseSwap wallet in NGN.
- Withdrawals go to a Nigerian bank account in your own name and are confirmed with a one-time code.
- Any fees are shown before you submit a withdrawal.
- Withdrawals are reviewed before they are paid, and processing times depend on the bank or payment channel.
- We may hold or investigate transactions that appear suspicious.
- You are responsible for any taxes that apply to your sales.
7. Prohibited conduct
Do not use RiseSwap for:
- fraud or money laundering;
- selling stolen, counterfeit or unlawfully obtained cards;
- getting around limits or security checks;
- interfering with the service; or
- any other unlawful purpose.
We may reject transactions, suspend or close accounts, and report activity to the authorities where the law requires.
8. Trademarks
RiseSwap is not affiliated with, endorsed by or sponsored by Apple, Amazon, Steam or any other gift card issuer. We use third-party brand names only to identify the cards you sell. All trademarks belong to their respective owners.
9. Account deletion
You can request account deletion in the app: Account > Request account deletion.
- Requests are processed manually within 14 business days.
- You cannot delete your account while you have orders in progress or pending withdrawals.
- Records that the law requires us to keep are retained as described in the Privacy Policy.
10. Liability
The service is provided "as is".
- We are not responsible for losses caused by invalid cards, cards blocked by their issuer, incorrect information you provide, bank rejections or events beyond our reasonable control.
- If our wilful misconduct or gross negligence directly causes you a loss, our liability is limited to the purchase price of the transaction involved, except where the law does not allow such a limit.
- Nothing in these Terms affects your statutory consumer rights.
11. Changes, governing law and disputes
- We will notify you in the app before material changes to these Terms take effect. If you continue to use RiseSwap after a change takes effect, you accept the updated Terms.
- These Terms are governed by the laws of the State of Texas, United States, without regard to its conflict-of-law rules.
- This does not deprive you of any protection given to you by the mandatory laws of the country where you live, including the Federal Competition and Consumer Protection Act 2018 and the Nigeria Data Protection Act 2023 if you live in Nigeria.
- Please contact in-app support first to resolve any dispute. If a dispute cannot be resolved that way, it may be brought before the state or federal courts located in McLennan County, Texas, unless the law of your country gives you the right to bring it in your local courts.
